Terms and Conditions
2025
Welcome to Kactus Media. By engaging with our services, you agree to the following Terms and Conditions. Please read them carefully before using our website or working with us.
1. Scope of Services
Kactus Media provides digital marketing services, including but not limited to social media management, ad campaign management, content creation, and consulting. All services are subject to the terms outlined herein.
2. Client Responsibilities
Clients agree to:
-
Provide accurate, complete, and up-to-date information necessary for the delivery of services.
-
Respond to content, approvals, and inquiries in a timely manner to avoid delays.
-
Review and approve materials before publishing. Once approved, Kactus Media is not liable for errors or omissions.
3. Account Access and Passwords
In order to perform certain services (e.g., running ads, managing social media, accessing analytics), clients may be required to share access credentials for platforms such as Meta (Facebook/Instagram), Google Ads, Linkedin.
By providing login credentials, you acknowledge and agree that:
-
You grant Kactus Media permission to access and manage your account(s) solely for the purposes outlined in the agreed scope of work.
-
You remain the owner of the accounts and can revoke access at any time, but doing so may impact deliverables or timelines.
-
Kactus Media will take reasonable measures to protect your credentials and access, but is not liable for platform-related errors, breaches caused by third parties, or changes made outside of our control.
We recommend sharing access via secure methods (e.g., Business Manager, user invitations) rather than direct passwords whenever possible.
4. Use of Third-Party Tools
To deliver our services, Kactus Media may use third-party tools, platforms, or software (e.g., scheduling tools, analytics platforms, design tools).
You acknowledge that:
-
These third-party services have their own terms and privacy policies, and we are not responsible for any downtime, data loss, or service interruptions caused by them.
-
We do not guarantee the performance, security, or availability of third-party platforms.
5. Intellectual Property
Unless otherwise agreed in writing:
-
Content created by Kactus Media (including graphics, copy, and strategies) is the intellectual property of Kactus Media until full payment is received.
-
Upon payment, ownership of custom content transfers to the client.
-
Kactus Media reserves the right to use work samples in our portfolio unless the client specifically requests confidentiality in writing.
6. Confidentiality
Kactus Media agrees to maintain the confidentiality of client materials, data, and credentials shared during the course of our work. We do not share or sell client information to third parties.
7. Limitation of Liability
Kactus Media is not liable for:
-
Any direct or indirect damages arising from the use of our services.
-
Platform suspensions, algorithm changes, or account bans that occur due to policy violations not caused by our actions.
-
Any losses resulting from actions taken by third-party providers or service platforms.
Clients are responsible for complying with all platform-specific advertising and usage policies.
8. Payment and Cancellation
-
All invoices must be paid according to the terms stated in the proposal or service agreement.
-
Late payments may result in paused services or termination of the project.
-
Either party may terminate the engagement with written notice, subject to agreed-upon cancellation policies in the contract.
9. Dispute Resolution
Any disputes will first be attempted to be resolved through good-faith negotiation. If unresolved, disputes will be subject to the laws and jurisdiction of United Arab Emirates.
10. Updates to Terms
We reserve the right to update these Terms and Conditions at any time. The most recent version will always be available at kactusmedia.com/terms.
